1. Introduction
These Terms of Service (“Terms”) govern the use of the software platform and related services (the “Service”) provided by Cruv Dimension Pvt. Ltd. (“Cruv,” “we,” “us,” or “our”), a company incorporated in India. By accessing or using the Service, you (“you” or “Client”) agree to these Terms.
2. Description of Service
Cruv provides a business software platform that allows clients to create automated workflows and communicate with their contacts (such as leads and customers) through messaging, email, and voice channels, along with dashboards and reporting tools to monitor usage.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when registering for the Service.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including data protection and anti-spam regulations. You are responsible for obtaining any necessary consent from individuals before contacting them through the Service. You agree to comply with the terms and policies of any third-party platforms (such as messaging or communication providers) accessed through the Service.
You shall not use the Service to send unsolicited messages, transmit unlawful or harmful content, impersonate any person, or interfere with the security or operation of the Service.
5. Fees
Use of the Service is subject to fees as agreed between Cruv and the Client under a separate commercial agreement. Fees may be based on usage.
6. Intellectual Property
Cruv retains all rights to the Service and its underlying technology. Clients retain ownership of their own data and content submitted to the Service.
7. Data and Privacy
Client data is processed solely to provide the Service. Clients are responsible for ensuring they have appropriate rights and consents for any data they submit to or process through the Service.
8. Disclaimer of Warranties
The Service is provided “as is” without warranties of any kind, express or implied, to the fullest extent permitted by law.
9. Limitation of Liability
To the fullest extent permitted by law, Cruv shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Cruv's total liability shall not exceed the fees paid by the Client in the three (3) months preceding the claim.
10. Termination
Cruv may suspend or terminate access to the Service for violation of these Terms or applicable law.
11. Changes to These Terms
Cruv may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of India, and any disputes shall be subject to the jurisdiction of the courts of India.
